Anyone called the cops on BB?

We have word that BB will try to refuse DH contact tonight for his School holiday week.

Our lawyer has confirmed that we should be able to pick the skids up thisafternoon, but BB is claiming that because we had the kids last weekend (for EOWE) that this is HER weekend and we can pick the skids up on Monday. (Not what the orders say.)

We get all this through the skids, of course. rolleyes

What do we do if we get there and she won’t let us have the skids? Call the cops I guess??

Yep he has a copy of the CO with him, I have the # of the police in my wallet now.

We expect an email from her today sometime.. that’s what the kids said at any rate. We haven’t heard anything yet.

I really hope she hasn’t taken them somewhere. I guess if we turn up and they aren’t there.. we will spec out some of her friends houses and then get a police report filed.

has gone to buy a voice recorder…

The last time he tried to pick the kids up and she denied him, she threatened to put an AVO on him if he didn’t do what she wanted.

It would be great to get that on tape if she tries it again.

at 6:05 pm.. just as they were leaving. I guess she didn’t want to be at home when we turned up at the usual time of 6:30 pm. We were just doing a drive-by to see if they were there as we had a fast run over there.

As predicted, she wouldn’t let us have the kids. crying

We called the police they said it was not under their juristiction and that they would do nothing. crying

I’m sitting here filling out the forms to take her back to court.

We have orders.. but in the grand scheme of things, what the f*ck good are they?

I’m not sure what stunt you were trying to pull tonight. I was very surprised to see you turn up to pick up the children. The schedule says you are having the children next week-end – not this week-end. Yes – as you said to me – the access orders say you’re having the children for the first week of the NSW school holidays. When did weeks begin on Friday nights? According to my calendar the first day of the week is Sunday.

I was planning to send you an email tonight confirming that you’d be picking up the children at 6.30pm on Sunday night (as per the usual time that you pick up the children) and you will bring them back at the usual Sunday time the following Sunday.

Am I to assume that you were planning to have them this week-end and next week? I really don’t understand what you’re trying to do. A week is seven days – not nine. How – as you claim – can your lawyer be saying that it’s correct for you to pick up the children tonight – when you had them last week-end (as per the schedule) and you’re having them next week-end (as per the schedule), and you’re having them all next week. Go figure.

How do you think the children felt tonight when you turned up saying that your lawyer says they have to go with you. SS11 and I looked at the schedule together earlier in the week to make sure that I had it correct – and yes I did have it correct according to the schedule and they were very aware they’re with me this week-end and looking forward to the things we have planned.

If you have a different understanding - perhaps you’d better explain it. You were already aware that the children were planning their week-end with me – via your phone conversation with them on Thursday night. SS11 told me about the conversation. SS11 said he’s told you that you’d be picking them up either Sunday night or Monday morning (Monday being his idea). If you had a discrepancy about it, you should have emailed me – rather than just turning up and upsetting the children.

I’ll assume that you’ll be here to pick up the children as 6.30pm on Sunday. If you turn up before then – we may not be here – but we will be back by 6.30pm.

I have included her email, and the following commentary in the Affadavit..

The respondent has relied heavily on the inaccurate schedule she compiled, and has also relied on the children (specifically SS11) to pass messages to me, although she has herself acknowledged that the children get things easily confused. I requested that she not pass messages via the children in a phone conversation on 14/12/04 between 6:00 and 6:50 pm. At that time she claimed that she did not send messages via the children.

Although I did receive a garbled message from my son, I chose to rely instead upon my communications with his mother, as they appeared very clear to me, and conformed to the court orders as confirmed with Expensive Lawyer LLB of Expensive & Inept Solicitors. That is, it was indeed usual for the contact week for school holidays to begin on the Friday.

SS11 told me that the respondent would email me, however, as no email was forthcoming (it was checked at about 5:00 pm, just before leaving for the trip to HickTown) I proceeded with the timing as per the Court Order, previous communications with the respondent, and legal confirmation from Expensive Lawyer LLB.

I collected the children from the respondent’s residence at 6:30pm on 3rd July as the respondent insisted, as I had no option available to me to enforce the order at that time.
